General Terms and Conditions

Your use of The Perfect Purée of Napa Valley, LLC (“Perfect Purée”) Site is expressly subject to the following Terms of Service and Conditions of Sale (“Terms and Conditions”). If you do not agree with any of these Terms and Conditions, do not access or otherwise use this website or any information or materials contained on this site, or place any orders or otherwise purchase products. Your use of the Site shall be deemed to be your agreement to abide by each of the Terms and Conditions set forth herein. We may update these conditions at any time and from time to time, and your continued use of the Site following any such change shall be deemed to indicate your acceptance of any modifications to these Terms and Conditions.

Account Security

By using this Site, you agree that you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, device or online account, and any account information saved thereon; and you agree to accept responsibility for all activities that occur under your account or password. Perfect Purée reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

Credit Card Charges

Orders are by credit card only. We accept Visa, MasterCard, and American Express. By entering your credit card information for your order with us, you are committing to the payment to Perfect Purée and also bound by the terms of your credit card agreement. The billing address for any such credit card needs to be provided at the time of your order and must be the address on your credit card statement. The billing address will be the address where your order will be shipped. If you wish to ship to an address different than your billing address, please provide this information at the time of your order. Please refer to the Privacy Policy as to how we use your address information.

Errors and Omissions

Occasionally, our listed prices, flavors or quantities may be incorrect. We make every effort to make sure that our product database is accurate; however, in the event any such mistakes occur, Perfect Purée shall be held harmless for any such errors. In the event that a discrepancy is identified prior to processing of an order, the customer will be contacted before any charges are made to the credit card so that the customer can make a decision to proceed or not proceed with the order (if possible). We will not fulfill an order if we determine in our sole discretion that it was entered due to a mistake, and will attempt to contact you in such event. If you make a mistake in the entry of an order that you place, contact us immediately before the order is processed so that we can correct your order. If your order has already shipped before you alert us to an error you made in the entry of your order, you may be responsible for additional shipping costs or other costs we incur as a result.

Sales and Shipping

Products Available

Products are available to purchase as single jars and cases. Cases contain 6 jars of the same flavor. Single jars and cases cannot be combined onto one order due to separate fulfillment locations in California which will impact shipping and handling charges. To purchase both single jars and cases please place two separate orders.

Order Fulfillment

• Orders shipped Monday through Thursday ONLY. (Except U.S. holidays)
• Orders received after 9:00 am PST will be shipped the following business day, unless received on Thursday. Orders received after 9:00 am PST on Thursday will ship the following Monday.
• Orders of single jars will ship from Napa, CA and orders of cases ship from Vernon, CA.

The Perfect Purée U.S. Holiday Schedule – Calendar Year 2024

Our offices are closed in observance of the U.S. holidays listed below. Orders will not be processed on these days. See below for details.

Single Jar Order Minimums & Maximums

• Minimum order is 1 jar
• Maximum order of the same flavor is 12 jars to the same purchaser or same shipping address per month.
• Orders over 12 jars will be referred to a local distributor.

Case Order Minimums & Maximums

• There are no minimum or maximum order limits on cases.

Shipping

• All products are PERISHABLE and will be shipped FROZEN via FedEx Standard Overnight.
• Shipping cost is based on FedEx Standard Overnight rates to the zip code provided.
• Single jars and cases are fulfilled through separate warehouses and incur a separate shipping fees.
• Shipping days are Monday-Thursday only.
• The Perfect Purée of Napa Valley ships to only the 48 contiguous United States. Orders with an Alaska or Hawaii shipping address will not be fulfilled.
• FedEx cannot deliver to Post Office Box addresses.
• All packages are released without signatures.
• To make sure that you are satisfied with your order, please fully inspect the product upon receipt.
• We are not responsible for product shipments that spoil or are delayed by FedEx due to:
  • Packages left unrefrigerated at delivery address for extended periods of time.
  • Packages transferred back to freight location due to customer absence at delivery address or incorrect or missing address information.
  • Delay in delivery time or delivery cancellation due to incorrect or incomplete delivery address, weather, or FedEx transportation mechanical issues.
• The Perfect Purée reserves the right to delay shipment of orders due to inclement weather or severe heat conditions. Customers with delayed orders will be contacted.
• Single jars are packed in an insulated foam container. Single jars are packed with dry ice except for orders of 6 jars and 12 jars. Cases are not packed with dry ice. Products ship frozen but upon delivery, product may not be completely frozen but should at least be cool to the touch. Upon receipt, immediately transfer product from the shipping container to your freezer. Note: In months when there are extreme heat temperatures, product may arrive thawed. Product should at least be cool to the touch.

Handling Fee
Orders of single jars include a handling fee for shipping materials, labor and dry ice if applicable. There is a $10 flat rate handling fee for orders containing cases.

Sales Tax

All products are sold in the state of California. We collect sales tax for the states to which we ship at the applicable rates for each state.

Cancellations, Returns & Refunds

• Order cancellations must be received by 8 am PST.
• We do not accept any physical returns due to the perishable nature of our products.
• If you believe that there is an issue with your order, please store the product in a freezer and contact us at (800) 556-3707 or info@perfectpuree.com within 7 days of receipt.

Storage & Handling

Purees, concentrates & zests
The shelf life of the purees, concentrates & zests is 2 years from date of manufacture if stored frozen. This Best By date is ink-jet coded on the side of the jar. When refrigerated below 40° F, the shelf life is up to 10 days. To use, thaw jars overnight in a refrigerator or quick thaw by placing jars in a bath of cool water. Once thawed out, stir before use.

Blends
The shelf life of our blends is 2 years from date of manufacture if stored frozen. This Best By date is ink-jet coded on the side of the jars. When refrigerated below 40° F, the shelf life is up to 21 days. To use, thaw jars overnight in a refrigerator. Once thawed out, stir before use.

Dispute Resolution – AGREEMENT TO ARBITRATION
Any dispute, claim or controversy arising out of or relating to these Terms and Conditions or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, with the exception of claims within the jurisdiction of the applicable small claims court, shall be determined by arbitration in San Francisco, California, before one (1) arbitrator who meets the requirements to serve as an arbitrator in the State of California. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures, unless we both agree at the time to the use of JAMS Streamlined Arbitration Rules and Procedures. The arbitrator shall follow any applicable federal law and California state law in rendering an award. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude the parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
